HF 3510 / SF 3692 – What This Bill Means for Asphalt Plants
Purpose of the Bill
This legislation is designed to stop traveling scam paving crews from
purchasing asphalt in Minnesota and defrauding homeowners.
Core objective: Ensure asphalt is sold only to legitimate, registered
contractors performing lawful paving work in Minnesota.
What Changes
Contractor registration will be required to purchase hot mix or warm mix asphalt for commercial paving, including:
- Driveways paved for hire
- Parking lots
- Residential or commercial paving projects performed for payment
Unregistered contractors may not legally purchase asphalt for these purposes.
Personal-Use Exception
Unregistered individuals may still purchase asphalt if:
- The material is for personal use
- No more than 5 tons per transaction
- No more than 10 tons per year per plant
What This Means for Asphalt Plants
- You have clear authority to refuse sales to unregistered contractors.
- You are not required to sell asphalt to suspicious buyers.
- You receive civil liability protection when acting under this statute.
This reinforces practices most plants already follow — verifying buyers and protecting legitimate contractors.
Penalties
Unregistered Contractors: Gross misdemeanor for purchasing or misrepresenting eligibility.
Sellers: Civil penalties only if knowingly selling to unregistered contractors (up to $1,000 per violation; up to $3,000 for repeat violations).
Effective Date
August 1, 2027 — allowing time for industry education and implementation.
